Kevin Alters legal practice consists of a general civil practice, with heavy emphasis on probate and probate litigation, guardianships and estate administration, Wills and estate planning, and real estate law, with additional work in the areas of business organizations, taxation, commercial transactions, and bankruptcy.  He is also experienced in Elder Law areas including Powers of Attorney, Directives to Physicians, and other advance directives; advice concerning Medicaid planning; and the drafting of living and testamentary trusts, including Special Needs Trusts, Qualified Income (Miller) Trusts, Section 867 Management Trusts, Section 142 Trusts, Marital Deduction Bypass Trusts, and Irrevocable Life Insurance Trusts (ILITs).

 

Mr. Alter has served as the primary attorney in charge of legal work for more than 100 guardianship cases, numerous estates (both independent and dependent administrations), numerous determination of heirship proceedings, and handling Will contests, bond surcharge litigation, fiduciary liability cases, constructive trust litigation, contested guardianship proceedings, and representation of subjects of civil commitment proceedings.  He has advised and served as a mentor for other attorneys in the probate and guardianship fields, and has testified in Court as an expert witness in trials of fiduciary liability cases.

Kevin Alter has given speeches to various groups and organizations, including Houston Bar Association, Department of Veterans Affairs (Houston Regional Office), and Hadassah (Houston Chapter) on topics of probate, wills, administrations, guardianships, and advance directives.  He has developed a particular expertise in handling both guardianships and federal fiduciary appointments involving VA benefits payable to disabled or incapacitated veterans.

 

Mr. Alter co-authored the Guardianships of Veterans and Dependents portion of the Texas Guardianship Manual, Second Edition (published by State Bar of Texas).
